These general conditions of sale (hereinafter the “General Conditions”) apply to any purchase made by a natural person (hereinafter the “CUSTOMER”) on the website http://www.lecrin.ch or from L'Ecrin Horlogerie Genève, a company registered in Switzerland under the name of:

Before using the L'Ecrin website and associated pages (the “Site”) and/or placing an order, we invite you to carefully read all the provisions of these General Terms and Conditions of Sale as well as the Privacy Policy.
Each order placed with L'Ecrin via the Site or in person by visiting our premises is governed by these General Terms and Conditions of Sale. Unless otherwise stated, these apply to the exclusion of all other conditions.
Our General Terms and Conditions of Sale may be amended when a new version is published on the Site. The General Terms and Conditions of Sale that apply are those in force at the time of the order, unless modified by law or a governmental authority.
Any order placed on the site can be delivered in Switzerland, in a member state of the European Union or in any other state where our carriers can make deliveries.
The prerequisite for placing an order is the creation of an account by transmitting personal information for your registration, including in particular your name, email address, telephone number and postal address. This information should be accurate and up to date.
Please inform L'Écrin of any changes made to your personal data on the Site without delay.
The products for sale on the Site are exclusively reserved for adults who have the full exercise of civil rights. Persons under the age of 18, or whose exercise of civil rights is limited, are authorized to purchase Products only with the agreement and under the supervision of a parent or legal representative.
Once you have registered, the confidentiality and security of your identifiers are exclusively your responsibility. Any successful login with your credentials will be considered a personal act.
In the event of theft or misuse of your identifiers, contact L'Écrin immediately. If L'Écrin notices fraudulent use, the account will be suspended.
You can order by internet, email, telephone or in person (by appointment).
To order on the Site, click on “Add to basket”, then check the order, select the delivery method and check the total amount. You can also pick up your orders in store.
After acceptance of the General Terms and Conditions of Sale, indicate the payment data to finalize the order.
The order will be finalized and you will be bound by it, and in particular by the stipulated price, as soon as you click on the Validate Payment button.
L'Écrin may refuse, delete or cancel an order for any reasonable reason (unavailability, litigation, suspicion of fraud, etc.). In case of cancellation, the amount paid will be refunded.
Prices are indicated in Swiss francs, all taxes included, excluding customs fees or foreign taxes.
Delivery costs are offered by L'Ecrin.
L'Ecrin may change prices in the future, but the changes do not apply to orders that have already been confirmed.
Payment is made using the selected method: credit card, bank transfer or cash.
Confirmed orders are delivered to the specified address or made available in store.
L'Ecrin can contact you for information on ordering and delivery.
Shipment within 1 to 4 working days after confirmation and payment. In-store pickup by appointment.
L'Ecrin remains the owner of the products until full payment is made.
In case of delivery, L'Écrin assumes the risk until received by the customer (signature required).
In case of withdrawal in store, the risk is transferred to the customer at the time of withdrawal.
Upon delivery or collection, check the conformity of the products.
In case of damage or missing item, report it to the carrier and contact customer service within 2 days.
In the absence of notice within this period, the products are deemed to have been received in good condition.
For an invisible defect, notify L'Écrin immediately and at the latest within two days.
The right of withdrawal does not apply under any circumstances, whether you are residing in the European Union or in Switzerland.
Swiss law does not provide for any withdrawal period or other right of return once the order has been placed.
If you perform the duties provided for in article 3.3, all Products sold by L'Ecrin are guaranteed for one (1) year, unless there is a longer mandatory requirement in your country.
The guarantee takes effect on the delivery date and is justified by the invoice.
The L'Écrin warranty is excluded if a guarantee is offered by a third party (manufacturer, authorized repairer).
The warranty does not cover defects resulting from an accident, mishandling, improper use, negligence, improper storage, unauthorized modification or repair, normal wear and tear.
To claim the warranty, send the products at your expense. If required by law, shipping costs will be reimbursed.
In case of warranty, L'Ecrin can repair, replace, replace, refund or return the product according to its choice.
The warranty set out in this article 4.2 is exclusive and replaces any other warranty on the Products or rights on your part in this context.
The photographs and texts on the Site are non-contractual and given for information purposes only.
L'Écrin cannot be held responsible for errors or omissions on the Site.
You acknowledge and agree that we will not be liable for any direct or indirect, incidental or consequential damages of any kind, including loss of profit, loss of use, loss of data, or other intangible losses. No claim may exceed the purchase price of the product (s) concerned.
L'Écrin declines all responsibility in the event of loss or damage following non-compliance with these General Terms and Conditions of Sale.
No provision excludes or limits liability in case of fraud or serious misconduct.
L'Ecrin cannot be held responsible for delays or absence of deliveries caused by circumstances beyond its reasonable control (“force majeure”).
In the event of a delay, the obligations are suspended and the execution period is extended.
If it is definitively impossible to deliver, the order will be cancelled and the price refunded.
These General Terms and Conditions of Sale constitute the entire agreement between L'Ecrin and the customer for the acquisition of products via the Site.
In case of contradiction with other provisions, priority is given to these General Terms and Conditions of Sale.
If one provision is void or unenforceable, the others remain in effect.
You may not assign or transfer any rights or obligations. L'Ecrin may assign or subcontract to any third party without prior consent.
Any tolerance or renunciation by L'Ecrin does not constitute a waiver of enforcing the clauses.

The titles of the articles are indicative and do not alter the conditions.
Subject to mandatory provisions, the General Conditions of Sale and the purchase of products on the Site are governed by Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods.
Any dispute will be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland, except for imperative cases.
