A watch exchange consists of two elements:
The elements of a watch exchange transaction are governed by these Purchase Terms and our Terms of Sale, respectively.
We may consider that if the above items are not met, or if a respective obligation or commitment is not respected, the entire watch exchange transaction may be cancelled.
Price adjustment:
To the fullest extent permitted by applicable law, we disclaim and exclude all other conditions and warranties relating to the products or our systems, whether express or implied.
Under Reservation of provisions mandatory legal requirements, our overall liability to you for any order will in no case exceed one hundred percent (100%) of the Initial Offer or the Definitive Offer that we issued.
We reserve the right to cancel the purchase of your watch:
In case of cancellation, we will contact you as soon as possible in order to arrange for the return of your watch.
L'Ecrin may occasionally ask you for additional information. You must comply with all reasonable requests for information about you or your watch. If you do not respond to the verification requests, the transaction will be cancelled.
These Exchange Terms constitute the entire contract between the parties. In the event of any contradiction with other communications, these Terms will prevail.
If, after inspection, we discover that your watch contains non-authentic parts (possibly making the watch counterfeit), we will have to follow the appropriate legal procedures. We will keep you informed as far as the law allows us to.
We only use your personal information in accordance with our Confidentiality policy. Please be aware of it as it contains important conditions.
Any written notice should be sent to us by email to: lecrin.geneve@gmail.com. We will communicate with you via the email or postal address you provided to us.
If a provision is found by a court to be invalid, it will be severed without affecting the validity of the other clauses. This contract is strictly concluded between you and L'Ecrin.
These Terms are governed by the laws of the country of the Purchasing Entity. In the event of a dispute, you may initiate proceedings in the courts of the Purchasing Entity or those of your country of residence. Consumers residing in the EU can also use the online dispute resolution platform: http://ec.europa.eu/odr/.
Our used watches come with a twelve (12) month warranty from the date of receipt. It covers mechanical and manufacturing defects.
Warranty exclusions:
In the event of a complaint, we will provide a refund, repair, or replacement at our discretion. For residents outside Switzerland, customs fees and import taxes related to the return under warranty are your responsibility.
