General conditions of sale

These general conditions of sale (hereinafter the “General Conditions”) apply to any purchase made by a natural person (hereinafter the “CUSTOMER”) on the website www.lecrin.ch with L'Ecrin Horlogerie Genève, a company registered in Switzerland, with its head office at L'Ecrin C/O BDS, Avenue du Mail 22, 1204 Genève, Switzerland. IMPORTANT

Any order placed on the site implies the unreserved acceptance by the CUSTOMER of these general conditions.

Section 1. Definitions

• CUSTOMER : refers to the SELLER's contracting party who acts as a consumer.
• DELIVERY : refers to the first presentation of the PRODUCTS ordered by the CUSTOMER at the address indicated when ordering.
• PRODUCTS : refers to all the products available on the SITE.
• TERRITORY : refers to Switzerland.

Section 2. Purpose

These General Terms and Conditions govern the sale of PRODUCTS by the SELLER to its CUSTOMERS.

Section 3. Acceptance of the General Conditions

The CUSTOMER undertakes to carefully read these General Terms and Conditions and to accept them before proceeding with the payment of an order for PRODUCTS placed on the SITE.

Section 4. Purchase of Products on the Site

To buy a PRODUCT, the CUSTOMER must be at least 18 years old and have legal capacity.

Section 5. Commands

5.1. Characteristics of the Products

The SELLER undertakes to present the essential characteristics of the PRODUCTS.

5.2. Order procedure

Product orders are placed on the SITE. The CUSTOMER must follow the steps indicated to finalize the order.

Section 6. Right of Withdrawal

The terms of the right of withdrawal are provided for in the “withdrawal policy”, available on the SITE.

Section 7. Payment

7.1. Means of payment

The CUSTOMER can pay for his PRODUCTS online using the means offered by the SELLER.

7.2. Payment date

The CUSTOMER's account will be debited as soon as the PRODUCTS are ordered on the SITE.

Section 8. Proof and archiving

Any contract concluded with the CUSTOMER will be archived by the SELLER for a period of ten (10) years.

Section 9. Transfer of Ownership

The SELLER remains the owner of the PRODUCTS delivered until full payment is made by the CUSTOMER.

Section 10. Delivery

The terms of DELIVERY of PRODUCTS are provided for in the “delivery policy” available on the SITE.

Section 11. Packing

The PRODUCTS will be packed in accordance with current transport standards.

Section 12. Guarantees

The CUSTOMER benefits from legal guarantees for all PRODUCTS.

Section 13. Responsibility

The SELLER cannot be held liable in the event of non-performance due to the CUSTOMER or to a case of force majeure.

Section 14. Force Majeure

The SELLER's responsibility cannot be implemented in the event of force majeure.

Section 15. Personal Data/RGPD

The SELLER collects personal data to process orders. The CUSTOMER has rights to his data in accordance with the Swiss legislation in force.

Section 16. Complaints

The SELLER provides customer service that can be reached at +41 78 826 41 21.

Section 17. Intellectual property

All elements of the SITE are protected by copyright and are the exclusive property of the SELLER.

Section 18. Validity of the General Conditions

Any legislative change or judicial decision will not affect the validity of these General Conditions.

Section 19. Modification of the General Conditions

The General Conditions may be modified at any time by the SELLER.

Section 20. Competence and Applicable Law

These General Terms and Conditions as well as the relationships between the CUSTOMER and the SELLER are governed by Swiss law. In the event of a dispute, only the Swiss courts will be competent.
